This Privacy Policy explains how FabuLane Limited ("FabuLane", "we", "us") collects, uses, shares and protects personal data when you visit our website, request a quote or contact us by email, WhatsApp or Telegram. We handle personal data in line with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong (the "PDPO") and its six Data Protection Principles.

This policy also serves as our Personal Information Collection Statement.

1. Who we are

FabuLane Limited is a company incorporated in Hong Kong. We arrange freight forwarding and logistics services and are the data user responsible for your personal data under the PDPO. We are headquartered in Hong Kong, with hubs in Shenzhen and Kuala Lumpur and a client service center in Geneva.

2. Personal data we collect

Information you give us

  • Contact details: name, company, email address, phone or WhatsApp number, Telegram username.
  • Shipment details: origin and destination, cargo description, weight and volume, cargo-ready date, Incoterms, pickup or delivery addresses and any other information you include in your request.
  • Booking and shipping documents: for example commercial invoices, packing lists, bills of lading and customs information, which may contain the personal data of your staff, suppliers or consignees.
  • Communications: the content of emails and messages you send us.

Information collected automatically

  • Technical data: when you visit our website, our hosting provider's servers record standard log information such as your IP address, browser type, pages visited and time of visit.
  • Session cookie: when you send the quote form, a temporary session cookie is used to prevent spam and abuse (see section 7).

Providing personal data is voluntary. If you do not provide the information marked as required in our quote form (such as your name and email address), we may not be able to respond to your request or provide our services.

3. Why we use your personal data

We use your personal data for the following purposes and directly related purposes:

  • responding to your enquiries and quote requests;
  • obtaining and comparing freight offers from our partner forwarders, carriers and service providers on your behalf;
  • arranging, booking, managing and tracking shipments, customs clearance, insurance and delivery;
  • communicating with you about your requests and shipments;
  • invoicing, collecting payments and maintaining business records;
  • complying with legal, regulatory, customs, tax, sanctions and trade-compliance requirements;
  • protecting our website and services against fraud, spam and misuse; and
  • establishing, exercising or defending legal claims.

4. Who we share it with

We do not sell your personal data. To provide our services, we may transfer your personal data to the following classes of persons, who will use it only for the purposes above:

  • Partner freight forwarders and logistics providers in our network across Asia and elsewhere, so that they can prepare offers for your shipment and, once you book, carry it out;
  • Carriers and service providers, such as shipping lines, airlines, trucking companies, warehouses, customs brokers and insurers;
  • Government and regulatory bodies, such as customs and tax authorities, where required for your shipment or by law;
  • Our technology and service providers, such as website hosting, email and IT providers, and professional advisers such as accountants and lawyers;
  • Our affiliated companies, for internal administration and to support our services; and
  • a purchaser or successor in the event of a merger, acquisition or reorganisation of our business.

When we share a quote request with partner forwarders, we share only the information reasonably needed for them to prepare an offer.

5. Transfers outside Hong Kong

Because freight is international and our team and partners are located in several places, your personal data may be transferred to, stored in or accessed from places outside Hong Kong, including Mainland China, Malaysia, Switzerland, the origin and destination countries of your shipment, and the countries where our service providers operate their systems. Data protection laws in these places may differ from those in Hong Kong. We take reasonable steps to ensure that personal data transferred outside Hong Kong is protected to a standard comparable to the PDPO.

6. Direct marketing

We will only use your name and contact details to send you direct marketing about our freight and logistics services if you have given us your consent. You can withdraw your consent at any time, free of charge, by emailing service@fabulane.com or by using the unsubscribe option in any marketing message. We do not provide your personal data to others for their own direct marketing.

7. Cookies and similar technologies

  • Session cookie: when you send our quote form, a strictly necessary session cookie is set to limit repeated submissions and protect against spam. It is deleted when you close your browser.
  • Web fonts: our website loads fonts from Google Fonts. To deliver them, your browser connects to Google's servers, which receive your IP address. See Google's privacy policy for details.

We do not use advertising or analytics cookies on this website. If we introduce them in the future, we will update this policy and, where required, ask for your consent.

8. How long we keep your data

We keep personal data only as long as necessary for the purposes it was collected for. In general:

  • quote requests that do not lead to a booking are kept for up to 24 months, so we can respond to follow-up questions;
  • booking, shipment and accounting records are kept for at least 7 years, in line with Hong Kong tax and business record-keeping requirements; and
  • website server logs are kept for a limited period by our hosting provider.

We then delete or anonymise the data, unless a longer period is required or permitted by law.

9. How we protect your data

We take practical steps to protect personal data against unauthorised or accidental access, processing, erasure, loss or use. These include encrypted connections (HTTPS), access restricted to staff and partners who need it, and service providers bound to keep data confidential. No method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.

10. Your rights: access and correction

Under the PDPO, you have the right to:

  • ask whether we hold personal data about you, and request a copy of it (a data access request);
  • ask us to correct personal data that is inaccurate (a data correction request);
  • ask about our policies and practices on personal data and the kinds of personal data we hold; and
  • withdraw consent to direct marketing at any time.

To make a request, email service@fabulane.com with the subject "Personal Data Request". You may use the Data Access Request Form published by the Office of the Privacy Commissioner for Personal Data. We will respond within 40 days as required by the PDPO. As permitted by the PDPO, we may charge a reasonable fee for processing a data access request, and we will tell you the fee in advance.

If you are not satisfied with how we handle your personal data, you may contact the Office of the Privacy Commissioner for Personal Data, Hong Kong.

11. Clients in the EU, UK and Switzerland

If you are located in the European Economic Area, the United Kingdom or Switzerland, local data protection laws such as the GDPR or the Swiss Federal Act on Data Protection may also apply. We process your personal data to take steps at your request before entering into a contract and to perform our contract with you, to comply with legal obligations, and for our legitimate interests in running and protecting our business. You may have additional rights, such as the right to erasure, restriction, objection and data portability, and the right to complain to your local data protection authority. To exercise them, contact us as set out below.

12. Children

Our services are intended for businesses and adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has provided us with personal data, please contact us and we will delete it.

Our website contains links to third-party services such as WhatsApp and Telegram. When you use them, their own privacy policies apply, and we are not responsible for how they handle your data.

14. Changes to this policy

We may update this Privacy Policy from time to time. The latest version will always be published on this page with its "Last updated" date. If we make significant changes, we will take reasonable steps to let you know.
